Terms and Conditions
Use nixly.in and our demo fairly. You must be 18 or older to use the paid Services. The demo is free for a limited number of uses, then paid. Custom builds are agreed through a written proposal, and what we build for you is yours. We will always be honest about what we can and cannot do, and we ask the same fairness in return. The details follow.
1. Agreement
These Terms and Conditions ("Terms") govern your use of the website nixly.in, our demo, and related services (together, the "Services") provided by Nixly Automations Private Limited ("Nixly", "we", "us"), a company incorporated in India with CIN U63999DL2026PTC467791 and its registered office at Ground Floor, 35-C, Block K, Saket, New Delhi 110017.
By using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
2. What Nixly does
Nixly builds AI voice and message agents and business automations, designed around each client's business. The website describes our work, lets you try a demo, and lets you start a conversation about a build. Descriptions on the website are an introduction, not a fixed offer. The exact scope, price, and timeline of any build are agreed in a written proposal or agreement between you and Nixly, and that agreement governs the engagement. If anything in such an agreement conflicts with these Terms, the agreement wins for that engagement.
3. Demo accounts and eligibility
You must be at least 18 years old to create a demo account, make a payment, or otherwise use the paid Services.
To try the demo, you sign in with accurate details. You are responsible for keeping your sign-in credentials safe and for activity under your account.
The demo includes a limited number of free uses per account. After the free allowance, continued access requires payment as displayed at the time. We may reasonably adjust the free allowance, features, or pricing of the demo, and any change applies from the date it is posted, not retroactively to what you already paid for.
The demo exists to show you what our agents can do. It is a demonstration, not a production system, and should not be relied on for live business operations. Your demo conversations are processed by the AI infrastructure providers described in our Privacy Policy.
4. Payments and refunds
Payments on the website are processed by an RBI-authorised payment processor, which we will name here before paid access goes live. Prices are shown in Indian Rupees and include applicable taxes unless stated otherwise. GST invoices are issued for all paid services.
Demo access payments.
If a technical failure on our side prevents you from using demo access you paid for, tell us at contact@nixly.in and we will either restore your access or refund the unused amount. Beyond that, demo payments are non-refundable once the access has been used.
Custom build payments.
Payment schedules, milestones, and any refund terms for custom builds are set out in the written proposal for that engagement. As a rule we invoice against agreed milestones, so you pay for work as it is delivered, not blindly in advance.
Approved refunds are processed to the original payment method within 7 to 10 working days.
5. Your content and your data
Anything you submit through the Services, such as enquiry details, feedback, and business information, remains yours. You grant Nixly permission to use it only to respond to you, prepare your proposal, and deliver the Services. Our Privacy Policy explains how we handle personal data.
You agree that what you submit is accurate, is yours to share, and does not violate any law or anyone's rights.
6. Ownership of what we build
Systems we build and deploy for a client under a paid engagement belong to the client on full payment, as set out in the engagement agreement. Deployed builds run on the client's own systems.
Everything else remains Nixly's: the website, the demo, our brand, our logo, our content, and the general know-how, methods, tools, and templates we use and improve across engagements. Nothing in these Terms transfers those to anyone.
7. Fair use
You agree not to:
- Copy, resell, scrape, or reverse engineer the website or demo
- Use the demo or Services for anything unlawful, harmful, or deceptive
- Attempt to bypass usage limits, payments, or security measures
- Misuse the demo to send spam or unsolicited communication to others
- Impersonate another person or business
We may suspend or terminate access for violations of these Terms. Where reasonable, we will warn you first. That is our preference; we built Nixly on honesty, not gotchas.
8. Third-party services
The Services rely on and may link to third-party services such as hosting, analytics, payments, AI infrastructure, and WhatsApp. Those services have their own terms and privacy policies, and Nixly is not responsible for their content or practices.
9. Honest limits
We put real care into the Services, and we are equally honest about their limits. The website and demo are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. AI systems can make mistakes; the demo may occasionally answer imperfectly or be unavailable.
For custom builds, the commitments we make are the ones written in your engagement agreement. We do not promise specific business results, revenue, or growth figures, and we never will, because nobody honestly can.
10. Limitation of liability
To the maximum extent permitted by law, Nixly's total liability arising out of or relating to the website and demo shall not exceed the amount you paid to Nixly through the website in the 3 months before the claim arose. Nixly shall not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, revenue, or data, arising from use of the website or demo.
Liability for custom build engagements is governed by the engagement agreement. Nothing in these Terms limits liability that cannot be limited under Indian law.
11. Indemnity
You agree to indemnify and hold harmless Nixly Automations Private Limited, its directors, employees, and agents from claims, damages, and reasonable legal costs arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
12. Suspension and termination
You may stop using the Services at any time and may ask us to delete your demo account by writing to contact@nixly.in. We may suspend or discontinue parts of the website or demo for maintenance, improvement, or business reasons. If we discontinue something you have paid for and not yet used, we will refund the unused portion.
Sections that by their nature should survive termination (including ownership, liability, indemnity, and governing law) survive it.
13. Changes to these Terms
We may update these Terms from time to time. The current version will always be posted here with its date. Material changes will be notified on the website before they take effect. Continued use after changes take effect means you accept them.
14. Governing law and jurisdiction
These Terms are governed by the laws of India. Subject to any arbitration or dispute clause in a specific engagement agreement, the courts of New Delhi, NCT of Delhi shall have exclusive jurisdiction over disputes arising from these Terms or the Services.
